Thesis Title: “Gharar in Administrative Contracts: An Applied Jurisprudential Study“.
The Thesis examines the jurisprudential foundations of Gharar (uncertainty) in contracts, analyzing its concept, classifications, governing principles, and the underlying legal rationale upon which rulings are determined. It further explores the legal framework of administrative contracts, their types, distinguishing characteristics compared to other contractual forms, and the competent authorities responsible for adjudicating related disputes.
The study also addresses the legal rulings applicable to administrative contracts affected by Gharar, outlining their jurisprudential, regulatory, and judicial implications—particularly in relation to financial equilibrium, compensation, penalties, and subcontracting.
